&lt;P&gt;If you think lawyers talk too much, you have to read this new blog post...&lt;/P&gt;
&lt;P&gt;Recently, a Tennessee lawyer was suspended from the practice of law when he kept talking after a federal judge ordered him to keep quiet. A Chief U.S. District Judge said this talkative lawyer "harbors a disrespect for the institutional role of the judge," and that "this disrespect is so ingrained and deep-seated that he seems unable to realize its full extent, and he expresses it in ways that are clearly detrimental to himself".&lt;/P&gt;
&lt;P&gt;This lawyer was also convicted of contempt, fined $5,000 and sentenced to probation for the incident. During the hearing, the lawyer was being questioned about a possible conflict of interest. He was accused of repeatedly interrupting or speaking above the judge, of claiming the prosecution was conspiring to prevent him from trying cases, and of threatening to remain mute. When the judge asked him to keep quiet, this asked to speak to his client, prompting the judge to order him jailed.&lt;/P&gt;

&lt;P&gt;Would you buy a car or house sight unseen? Most people wouldn't but when it comes to purchasing insurance, that's exactly what most people do. &lt;BR&gt;&lt;BR&gt;Jonathan Stein, a fellow plaintiff's attorney in Northern California, posted a very interesting article on his blog (California Personal Injury and Insurance Blog &lt;A href="http://www.calpiblog.com/" target=_blank&gt;http://www.calpiblog.com/&lt;/A&gt;) which really captured my attention. Here's Jonathan's post in part...&lt;/P&gt;
&lt;P&gt;************************&lt;BR&gt;"This is a fascinating topic for me. It came up in the course of an interview I gave to a reporter on a topic. (I will leave that for another time, after the article is published.) We discussed how you get a copy of an insurance policy.&lt;/P&gt;
&lt;P&gt;I called the California Department of Insurance. I asked for a policy. After all, they keep them all there. The answer: The DOI does not give you copies of policies. Why? Because they don't know which policy, if any, you would get from a specific insurer.&lt;/P&gt;
&lt;P&gt;So, I called some local agents. These were agents for some of the major insurance companies. I asked for a specimen policy. I was told that I could not get a specimen (sample) policy. &lt;/P&gt;
&lt;P&gt;It is fascinating to me that insurance companies sell a product but they will not let you see the product before you buy it. Imagine buying a car without test driving it. Or buying a house sight unseen. You would never do that, but insurance companies won't let you see what you buy until after you buy it. Amazing!&lt;/P&gt;

&lt;P&gt;Last week and for the 18th time in approximately seven years, an innocent man cleared by DNA testing reportedly has been released from prison by one Texas county.&amp;nbsp; After serving 27 years in prison for the murder of his girlfriend, 55-year-old James Woodard walked out of a Dallas courtroom yesterday, a free man.&lt;/P&gt;
&lt;P&gt;Woodard could have been released earlier, if he admitted his "guilt" in the rape-murder to the state parole board. But he refused to do so. &lt;P&gt;Unfortunately, we've handled many wrongful drowning cases over the years and almost without exception, most of the drownings which involved small children could have easily been avoided. &lt;/P&gt;
&lt;P&gt;Here are several important statistics obtained from the Orange County Fire Authority and Orange County Coroner…&lt;/P&gt;

&lt;DIV style="MARGIN-RIGHT: 0px"&gt;Since 2000, between four and twelve children age 4 and under have died each year from accidental drownings in Orange County.&lt;BR&gt;&lt;/DIV&gt;&lt;/LI&gt;
&lt;LI&gt;
&lt;DIV style="MARGIN-RIGHT: 0px"&gt;Of children who survive near-drownings, 5 to 20 percent suffer severe and permanent disabilities.&lt;BR&gt;&lt;/DIV&gt;&lt;/LI&gt;
&lt;LI&gt;
&lt;DIV style="MARGIN-RIGHT: 0px"&gt;Within 30 second under later, a child loses consciousness. Within 4-6 minutes, the child suffers irreparable brain damage.&lt;BR&gt;&lt;/DIV&gt;&lt;/LI&gt;

Larry Zimmerman, 43, was attacked by the pit bull as he walked his own dog in the gated community of College Park. After attacking Zimmerman, the dog then turned on his neighbor James Kim, 59.&lt;/P&gt;
&lt;P&gt;Zimmerman and his Siberian husky, Zorro, were out for a walk when two dogs began to nip at the husky. The dogs started attacking him and he climbed onto a nearby car's roof. One of the dogs then tried to pull him off. "I kicked the (expletive) out of that dog. I fought for my life," Zimmerman said.&lt;/P&gt;
&lt;P&gt;The dog then ran down the street toward Kim, 59, who was taking an evening stroll with his wife, and attacked them. &lt;/P&gt;
&lt;P&gt;Zimmerman spent the night at La Palma Intercommunity Hospital for bites on both of his legs and his left arm. Kim received five stitches in his chest.&lt;/P&gt;
&lt;P&gt;"I love dogs and everything," Zimmerman said from his hospital bed on Thursday afternoon. "But you need to have control of your dogs. &lt;P&gt;A Los Angeles Superior Court jury has awarded more than $15 million in compensatory damages to a teenager who suffered permanent brain injuries after his mother's car was struck by a Southern California Gas Co. truck in 2005.&lt;/P&gt;
&lt;P&gt;The minor victim, now 17, was a passenger in the family's Chrysler sedan when it was hit by a gas company-owned pickup truck. The truck driver admitted runing a red light and striking the passenger side of the victim's sedan.&lt;/P&gt;
&lt;P&gt;&lt;BR&gt;At the time of the accident, the minor was 14 and he struck in the head by a door frame and was pushed against a console. Almost half of his body was compressed.&lt;/P&gt;
&lt;P&gt;After the accident, the minor was comatose for 24 hours and spent nine days in the hospital. He was diagnosed with a permanent frontal-lobe brain injury, which left him cognitively disabled with impaired judgement and an inability to regulate his moods. He also retained a drooping left eye, partial face paralysis and a six-inch scar on his head.&lt;/P&gt;
&lt;P&gt;The minor was an active teenager before the accident, earning As and Bs in school and enjoying dirt biking, skateboarding and repairing bicycles. He testified at trial that his personality "completely changed" after the accident. He said he suffers from depression, lacks ambition and can no longer engage in many physical activities. He also reportedly suffers from fatigue, anxiety and speech difficulties.&lt;/P&gt;

&lt;P&gt;On April 4, 2008, the District Court of Appeals, First District, State of Florida upheld the Florida Office of Insurance Regulation’s suspension of Allstate from writing insurance in the State of Florida.&lt;BR&gt;&lt;BR&gt;The court found Allstate guilty of arbitrary reductions of "bodily injury claim payments to its policyholders and beneficiaries by up to 20%." &lt;p&gt;Conducting a proper Voir Dire and giving a properly presented strong Opening Statement are two good ways to set a favorable tone and win your case early.&lt;/p&gt;
&lt;p&gt;First be polite and be yourself.&amp;nbsp; Jurors can read a phony from a mile away.&amp;nbsp; By the same token, being the attorney in the courtroom who&amp;nbsp;comes across as the most likeable, honest and credible will give you a huge advantage.&lt;br&gt;&lt;br&gt;Next, remember the "2 minute" drill.&amp;nbsp; What do I mean by this?&amp;nbsp; Well, the initial impression of a story or set of facts is critical,&amp;nbsp; It’s always important to tell your story and capture the jury’s attention within the first 2 minutes of your opening.&lt;br&gt;&lt;br&gt;More than one study has shown that people’s opinions about various issues are decided within the first couple of minutes of discussion.&amp;nbsp; As such, it’s important to make sure you make your point at the beginning of your opening statement.&lt;br&gt;&lt;br&gt;During your opening, you also need to make sure that you tell the jury what you’re going to say or show them during the trial.&amp;nbsp; During trial, you then need to say, do and show the jury what you promised them in your opening.&amp;nbsp; In your closing, you will remind the jury what you said and what you showed them during the trial.&lt;br&gt;&lt;br&gt;This builds consistency, familiarity and gives you validity.&amp;nbsp; It’s important to keep this process in mind throughout the entire trial.&lt;br&gt;&lt;br&gt;Don’t make express or implied promises during opening that you can’t keep.&amp;nbsp; Jurors will remember your promise and take it personally if you break that promise, even if it wasn’t your fault.&lt;br&gt;&lt;br&gt;For example, in a case where you have a group of people who observed the defendant run a red light, rather than say "Bob Smith is going to come in to court and testify that he saw Mrs. Smith run the red light", it might be better to say something like, "A witnesses will come into court and testify that Mrs. Smith ran the red light."&amp;nbsp; A subtle difference to an important promise.&amp;nbsp; This gives you some level of flexibility should "Bob Smith" leave the country without notice to you.&amp;nbsp; Another witness can be brought in to provide the same or similar testimony.&amp;nbsp; You’ve avoided the appearance of not keeping your promise to the jury.&lt;/p&gt;
&lt;p&gt;I read long ago about well know attorney Philip Corboy’s four things to NEVER DO during and opening statement.&amp;nbsp; They read as follows:&lt;/p&gt;
&lt;blockquote dir=ltr style="MARGIN-RIGHT: 0px"&gt;
&lt;p&gt;NEVER read your opening statement;&lt;/p&gt;
&lt;p&gt;NEVER tell the jury that your opening statement is not evidence;&lt;/p&gt;
&lt;p&gt;NEVER drink water from in front of the jury (we talked about this in an earlier post- juror’s can’t drink water so why should you be able to?);&lt;/p&gt;
&lt;p&gt;NEVER stand immediately in front of the jury.&amp;nbsp; Stand back and give them their space.&amp;nbsp; Four good points worth thinking about and remembering.&lt;/p&gt;&lt;/blockquote&gt;

&lt;p align=justify&gt;According to the U.S. Coast Guard, there are nearly 12 million registered boats in the United States, with 95 percent of them being less than 26 feet in length. California has about one million registered recreational vessels.&lt;/p&gt;
&lt;p align=justify&gt;Collisions with other boats, or other type of water craft, is the most common cause of injury or death in boating accidents. Other causes of injury are slip and falls, reckless driving, drunk driving, boat malfunctions and inexperienced water craft operators. It is a general rule of law that the owner and operator of a boat have a duty to exercise the highest degree of care in order to prevent injuries and death to others.&lt;/p&gt;
&lt;p align=justify&gt;These same boats account for as many as 80 percent of the underwater impact injuries in which people in the water are struck by a boat or its propeller. The majority of these accidents are the result of operator error, making them one of the most preventable of all types of boating accidents. While boat or propeller strike accidents are relatively few in number, as compared to other types of boating accidents, some of them are severe and have tragic consequences...&lt;br&gt;&lt;br&gt;Operator inexperience, incompetence, negligence and intoxication are significant contributing factors in reported boat and propeller strikes, as well as in all other types of boating accidents. In almost all cases, the victim is in the water -- a swimmer, scuba diver, fallen water skier or the operator or a passenger.&lt;/p&gt;
&lt;p align=justify&gt;Many boating case involve complicated areas of law ranging from diversity jurisdiction to state and federal conflict of law issues. Having experienced counsel represent your legal interest is a must.&lt;/p&gt;
&lt;p align=justify&gt;Every year, the U.S. Coast Guard compiles statistics on reported recreational boating accidents. These statistics are derived from accident reports that are filed by the owners / operators of recreational vessels involved in accidents. The occupant of a motor vehicle that collides with a train, is forty (40) times more likely to die, than if they had collided with another motor vehicle. Out of the more than 300,000 rail grade crossings in the United States, more than 80% of all public railroad crossings don’t have lights and gates; one third of these crossings have no active warning device of any kind. Motorists are made unknowingly susceptible by the liability of an approaching train. Warning time is often minimal to nonexistent.&lt;/P&gt;
&lt;P&gt;More than half of all railroad mishaps occur at these unprotected crossings. For those lucky enough to survive, the injuries sustained are typically life threatening, requiring extensive surgical intervention, many necessitating amputation. Thus the type of injury which results from a motor vehicle colliding with a train or a child playing on or around a railroad track only emphasizes the need for limited access to railway areas and increased warning devices.&lt;/P&gt;
&lt;P&gt;Trains cannot stop in time to prevent a collision from occurring. For while an automobile traveling fifty (50) miles per hour requires approximately fifty (50) feet to come to a stop, it takes a train over a mile and a half to stop traveling from the same rate of speed.&lt;/P&gt;
&lt;P&gt;While grade crossing warning signals have become more high-tech and rail traffic has steadily increased, the railroads responsible for maintenance have continuously reduced their workforce, leaving the public at increased risk.&lt;/P&gt;
&lt;P&gt;Liability can be established against the railroad by proving vegetation was allowed to grow too high in the right of way, blocking the view of both the engineer and the driver of the vehicle. Often, engineers don’t blow the required whistle sequence because the whistle is so deafeningly loud in the cab of the train. The train’s "black box" can be retrieved which will show use of the whistle and speed of the train prior to impact. Communications between the train crew and dispatchers are recorded. These recordings, through contentious discovery, can be key in establishing liability against the railroad.&lt;/P&gt;
